These Conditions apply to all Customers and form part of each contract entered into between a Partner (Competition Organiser) and a Customer, and between toeandheel entries Limited and a Customer.
When you use the toeandheel.com website to make an online entry, you enter into TWO SEPARATE CONTRACTS:
1. A contract with toeandheel entries Limited - solely for the facilitation of your online entry submission
2. A contract with the Competition Organiser (Partner) - for your actual entry into the competition event
toeandheel entries Limited is NOT the Competition Organiser and is NOT a party to your competition entry contract.
1.1. The online entries facility on the toeandheel.com website is owned and run by toeandheel entries Limited.
1.2. toeandheel.com is a website platform only. It provides the technical infrastructure for online entry forms.
1.3. toeandheel entries Limited is a facilitation service only. It makes available a technological marketplace connecting Competition Organisers (Partners) with individuals wishing to enter competitions (Customers).
1.4. toeandheel entries Limited does NOT:
- Organise or run competition events
- Act as an Event Partner or Competition Organiser
- Take responsibility for competition entries beyond facilitating their submission
- Hold or control competition entries once submitted to Competition Organisers
toeandheel entries Limited provides a LIMITED SERVICE which includes ONLY:
2.1. Providing an online platform to collect entry information
2.2. Securely transmitting your entry information to the relevant Competition Organiser
2.3. Processing payment via PayPal and transferring funds (minus an administration fee) to the Competition Organiser
2.4. Confirming that your entry has been received and submitted to the relevant Competition Organiser
THAT IS THE FULL EXTENT OF OUR SERVICE.
toeandheel.com and toeandheel entries Limited are NOT responsible for:
- You are solely responsible for ensuring all information entered (including name spelling, age, age group, dance teacher, registration numbers, competition sections, etc.) is correct
- We do NOT check, verify, or correct information you enter
- We do NOT accept responsibility for any errors, omissions, or mistakes you make when completing the online entry form
- We do NOT make changes to entries after submission
- We do NOT pass messages to Competition Organisers regarding changes
- ALL requests to change entry details (spelling corrections, age group changes, section changes, etc.) must be made DIRECTLY to the Competition Organiser
- Contact details for Competition Organisers are available on their respective pages
- We do NOT act as an intermediary for communication between you and Competition Organisers
- We do NOT forward messages, requests, or queries to Competition Organisers
- All competition-related queries must be directed to the Competition Organiser
- We CANNOT issue refunds for competition entries
- All entry fees (minus our administration fee) are transferred to Competition Organisers weekly
- We do NOT hold or control these funds after transfer
- ALL refund requests must be made DIRECTLY to the Competition Organiser
- Refund policies are set entirely by the Competition Organiser
- We have no involvement in how competitions are run
- We cannot answer questions about competition schedules, rules, or arrangements
- We cannot resolve disputes about competition matters
- Review all information entered before submitting
- Ensure names are spelled correctly
- Verify age, age group, and all other details
- Confirm you have selected the correct competition sections
- Once submitted, YOU are responsible for contacting the Competition Organiser to make any corrections
- You are entering into a contract with the Competition Organiser, not with us
- Entry fees paid are for entry to the competition, not for our facilitation service (our administration fee is included in the total fee displayed)
- All competition rules, terms, and policies are set by the Competition Organiser
- Contact the Competition Organiser for ALL matters relating to your actual competition entry
- Contact us ONLY to confirm whether your entry was successfully received and submitted
5.1. When registering a participant, you will be asked to:
- Select the Event's category/categories in which you wish to register
- Provide information including: name, date of birth, dance teacher and registration card number
- Provide billing information: name, billing address and contact details
- Provide payment card information to PayPal (our third-party payment provider)
5.2. Your payment card will be debited at the time of booking.
5.3. Once payment is confirmed, your registration submission is complete, and you will receive an email confirmation.
5.4. This email confirmation confirms ONLY that:
- Your payment was successful
- Your entry information has been submitted to the Competition Organiser
- It does NOT confirm acceptance of your entry by the Competition Organiser
6.1. The fees for each transaction are displayed in the pricing section of the website and are stated inclusive of VAT.
6.2. All payments are processed through PayPal.
6.3. Payment Flow:
- You pay the full entry fee (including our administration fee)
- Funds pass through toeandheel entries Limited
- We retain a small administration fee for facilitating the entry
- The balance is transferred to the Competition Organiser weekly
6.4. Once funds are transferred to the Competition Organiser, we no longer hold or control them.
6.5. Payment Disputes:
- Any disputes regarding entry fees, refunds, or payment matters are between you and the Competition Organiser
- Each Customer and Partner releases toeandheel entries Limited from any liability in relation to payment disputes
- Refund requests must be made to the Competition Organiser, not to us
7.1. The website provides information about available Events and their details.
7.2. You are responsible for:
- Reading all event information carefully
- Checking availability and timings suit your plans
- Understanding the Competition Organiser's terms and conditions
- Complying with all arrangements specified by the Competition Organiser
7.3. When you register for an Event, a contract arises between you and the Competition Organiser. toeandheel entries Limited is NOT a party to this contract.
7.4. Each Competition Organiser has their own:
- Privacy Policy
- Terms and Conditions of Entry
- Cancellation and Refund Policy
- Rules and Regulations
- You should read these documents for each event you enter
8.1. toeandheel entries Limited does NOT handle cancellations or refunds.
8.2. The cancellation and refund policy for each event is set by the respective Competition Organiser.
8.3. ALL cancellation and refund requests must be made DIRECTLY to the Competition Organiser.
8.4. toeandheel entries Limited:
- Will NOT be responsible for processing refunds
- Will NOT be responsible for the cancellation and refund policies set by Competition Organisers
- Cannot issue refunds as funds have been transferred to Competition Organisers
9.1. Our liability is limited to the provision of the facilitation service described in Section 2.
9.2. We are not liable for:
- Any errors or mistakes you make when entering information
- Any consequences arising from incorrect information provided by you
- Any decisions or actions taken by Competition Organisers
- Any disputes between you and Competition Organisers
- Any issues relating to the competition events themselves
- Any losses arising from competition cancellations or changes
- Any refund disputes
9.3. Our maximum liability to you shall not exceed the administration fee we received for facilitating your entry.
10.1. Please refer to the toeandheel.com Privacy Notice for information about how your personal data is handled.
10.2. Your entry information is shared with the relevant Competition Organiser to enable them to process your competition entry.
10.3. Each Competition Organiser has their own Privacy Policy which you should read.
11.1. These Conditions and any non-contractual obligations arising out of or in connection with them are governed by, and will be construed in accordance with, Scots law.
11.2. The Scottish courts have jurisdiction to settle any disputes that arise under these Conditions.
11.3. Nothing in these Conditions shall constitute a partnership or joint venture of any kind between toeandheel entries Limited and any Customer or constitute either party the agent of the other for any purpose.
These Conditions apply to all Partners (Competition Organisers) and form part of the separate contract each Partner has entered into with toeandheel entries Limited.
1.1. This online entries facility on the toeandheel.com website is owned and run by toeandheel entries Limited.
1.2. toeandheel entries Limited makes available a technological marketplace for Competition Organisers (Partners) and competition entrants (Customers) to arrange online registrations for competition events.
1.3. toeandheel entries Limited does NOT act as an Event Partner or Competition Organiser.
2.1. toeandheel entries Limited creates a listing for each Event using information provided by the Partner.
2.2. Partners are responsible for ensuring all listing information is accurate and up to date.
3.1. Each Partner acknowledges and agrees that:
(i) Information Responsibility
- It is responsible for any and all information in its listing on this website
- It must notify toeandheel entries Limited promptly if any information changes
(ii) Payment Information
- It is required to provide correct bank account information to receive payment of Fees
- It will promptly notify toeandheel entries Limited should the account information change
(iii) Non-Competition
- It will not participate in any third-party service or website that competes with toeandheel entries Limited, without toeandheel entries Limited's prior written approval (which may be granted subject to conditions)
(iv) Customer Relations
- It is responsible for ALL communication with Customers regarding their competition entries
- It is responsible for handling ALL requests for changes to entries (spelling corrections, age group changes, section changes, etc.)
- It is responsible for ALL refund requests and cancellation policies
- It acknowledges that toeandheel entries Limited will NOT act as an intermediary for such communications
3.2. Entry information submitted by Customers (including name, date of birth, dance teacher and registration card number) will be passed to the Partner via secure data download.
4.1. Customers pay a fee (the Fee) when making an online registration. This fee includes the Partner's entry fee plus toeandheel entries Limited's administration fee.
4.2. The Fee structure (Partner entry fee and administration fee) is agreed between each Partner and toeandheel entries Limited.
4.3. Payment flow:
- Customers pay the full fee via PayPal
- toeandheel entries Limited retains the administration fee
- The balance is transferred to the Partner weekly
4.4. Once funds are transferred to the Partner, the Partner becomes responsible for any refunds requested by Customers.
4.5. Any payment disputes between Customers and Partners are the responsibility of the Partner. toeandheel entries Limited is released from any liability in relation to such disputes.
5.1. Each Partner understands and agrees that it is solely responsible for determining its applicable tax (including but not limited to value added tax) reporting requirements in consultation with its tax advisers, if considered appropriate.
5.2. toeandheel entries Limited cannot and does not offer tax-related advice to any Partner.
6.1. Each Partner is responsible for setting and managing its own refund and cancellation policy.
6.2. Each Partner is responsible for processing all refund requests from Customers.
6.3. toeandheel entries Limited will NOT process refunds on behalf of Partners.
7.1. These Conditions and any non-contractual obligations arising out of or in connection with them are governed by, and will be construed in accordance with, Scots law.
7.2. The Scottish courts have jurisdiction to settle any disputes that arise under these Conditions.
7.3. Nothing in these Conditions shall constitute a partnership or joint venture of any kind between toeandheel entries Limited and any Partner or constitute either party the agent of the other for any purpose.
7.4. These Conditions are personal to toeandheel entries Limited and each Partner.
7.5. toeandheel entries Limited and any Partner may assign its rights under these Conditions to any successor to its business. Otherwise, neither party shall assign or transfer any of its rights or obligations under this contract without the prior written consent of the other party.
